Instructions listened to or not, if a ride is unsafe enough to where serious injury or death could arise because it is not properly constructed, then said park is in the wrong. Do you have to sign a waiver before going on this water slide?

It IS properly constructed. Many waterslides are built similarly, and you're told beforehand to keep your body in a certain position to avoid lifting off like this.

It's not the park's fault if someone acting improperly injures themselves.
