There's the original news report here. The guy with the video gets rear ended by the black truck when the two lanes merge into one. The guy with the video, Ken, has right of way because he is obviously the car in front.
What Ken doesn't do right though is attempt to pull over as soon as he got hit. Even though it wasn't his fault, he still is in the wrong at that point, as he has failed to stop. I would have been pissed off too if I was the guy in the black truck.
I guess what we don't see though is the black truck guys initial reaction to the collision, it might have been completely obvious straight away to Ken that the guy was a total NUT and was dangerous.
